TAALAPATRA VIBES - TERMS OF USE

These Terms of Use outline the conditions for accessing and using www.taalapatra.com (the “Site”), owned and operated by Taalapatra Vibes (“Taalapatra,” “we,” “us,” or “our”). By visiting, browsing, or purchasing on this Site, you kindly confirm that you have read, understood, and agree to be bound by these Terms.

The Terms apply to every interaction and transaction on the Site, particularly regarding our distinctive handloom, handcrafted, culturally inspired décor and textile products. Please review them carefully. If you disagree with any part of these Terms, we respectfully ask that you do not use the Site or our services.

1. Eligibility to Use

By using our Site, you confirm that:

a) You are at least 18 years old or accessing the Site under the supervision of a parent or legal guardian

b) You are legally capable of entering into a binding agreement

c) You will comply with all applicable laws and regulations while using our services

Taalapatra is proud to offer handcrafted, handwoven, and hand-painted products, each made with care by skilled artisans.

Please understand:

a) No two pieces are exactly alike. Variations in colour, weave, print, brush strokes, and texture are inherent to handmade items and are not defects.

b) Our handloom fabrics, sarees, and decor items may exhibit minor inconsistencies or natural dye variations—these are a hallmark of authentic craftsmanship, not imperfections.

c) Handmade products are not mass-produced and may take longer to prepare, ship, or restock.

By purchasing from us, you acknowledge and celebrate these characteristics.

4. Cultural & Artistic Representation

The descriptions and stories shared on our website are meant to enhance your appreciation of these traditional art forms. Many of our designs, motifs, and artworks are inspired by India’s rich cultural, spiritual, and regional heritage.

Please note:

a) Our mythological, historical, and symbolic references are drawn from folklore, regional interpretations, and artisan storytelling—not definitive historical records.

b) Cultural beliefs and traditional narratives can vary widely across communities and geographies; they are best appreciated as expressions of heritage rather than absolute facts.

c) Products featuring spiritual motifs or religious symbols are offered with deep artistic respect, but do not claim to provide any spiritual or material benefit.

We encourage all customers to engage with these creations through a lens of cultural respect and open-minded appreciation.

5. Product Images vs. Actual Product

We make every effort to present our products as accurately as possible. However:

a) Photographs may vary slightly due to lighting, camera settings, and screen resolutions

b) Natural dyes and hand-painting techniques may cause subtle color shifts from batch to batch

c) These differences add to the charm of the product and are not considered flaws

6. Product Availability & Pricing

a) All products are subject to availability and may be discontinued or replaced at our discretion

b) Prices are listed in Indian Rupees (INR) by default and include GST (for Indian customers)

c) International orders may attract customs duties or import taxes, which are not included in our prices and are the buyer’s responsibility

d) We reserve the right to correct errors or update pricing and product details without prior notice

7. Payments

Payments are securely processed through trusted third-party gateways. We accept:

a) Credit/Debit Cards

b) Net Banking

c) UPI, Mobile Wallets

d) Razorpay and PayPal (international orders)

Taalapatra does not store your payment card details. Orders are confirmed only after successful payment authorization.

8. Shipping & Delivery

a) Processing times vary for ready-stock vs. made-to-order items

b) Delivery timelines are estimates and may vary based on location, customs, or courier delays

c) Tracking information will be shared upon dispatch

d) Any delivery issues must be reported within 24 hours of receipt

9. Returns & Exchanges

As most of our products are handmade or made to order, we follow a clear and fair policy:

a) Returns are accepted only in cases of genuine defects or incorrect items received

b) Claims must be accompanied by an original, unedited unpacking video

c) Custom or personalized products are non-returnable and non-refundable

10. Gift Cards

Taalapatra Digital Gift Cards (eGift Cards) are a beautiful way to share handcrafted joy.

Terms:

a) Available in pre-set denominations

b) Delivered via email and redeemable only on www.taalapatra.com

c) Valid for 12 months from the date of issue (unless specified otherwise)

d) Non-refundable, non-replaceable, and cannot be exchanged for cash

e) Partial use is allowed (remaining balance can be used later)

f) Cannot be used to purchase other gift cards

11. Intellectual Property

All content—including product designs, photographs, website layout, logos, and text—is the intellectual property of Taalapatra Vibes or its artisan partners.

You may not copy, reproduce, or use this content for commercial purposes without prior written consent.

12. Prohibited Conduct

While using our Site, you agree not to:

a) Post or transmit unlawful, abusive, or harmful content

b) Impersonate another person or misrepresent yourself

c) Attempt to access restricted areas or systems without authorization

d) Disrupt or interfere with Site functionality

e) Violate any applicable local or international laws

Violators may be subject to account suspension and legal action.

13. Limitation of Liability

Under no circumstances will Taalapatra Vibes, its owners, employees, affiliates, suppliers, or partners be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of, or inability to use, our products, services, or website. Your use of the Site constitutes agreement to this limitation of liability.

Our liability, if any, is limited to the amount paid for the item in question.

14. Disclaimer

The Site and its contents are provided “as is” and “as available”.

a) We do not guarantee complete error-free, uninterrupted, or virus-free operation of the Site. Users should employ suitable antivirus software and safeguards on their devices.

b) While we strive to present the most accurate and up-to-date information on our websites, we do not guarantee that product descriptions, images, pricing, availability, or other content will always be complete, reliable, current, or free from errors. As such, we cannot accept responsibility for any inaccuracies. We reserve the right to amend any typographical errors, inaccuracies, or omissions—especially those related to product descriptions, images, pricing, or availability—at any time and without prior notice.

c) We do not guarantee precise adherence to stated delivery timelines. Delivery dates are estimates and may be affected by external factors such as logistical delays, adverse weather conditions, or unforeseen circumstances beyond our control.

d) We have taken every care to represent the colours of our products on our website as accurately as possible. However, we cannot guarantee that the colour display on your device will be precise, complete, reliable, or free from discrepancies.

Taalapatra reserves the right to correct errors, update product information, and modify or withdraw products without prior notice. If a product you purchase from this website does not match its description, image, colour, etc., your only recourse is to return it in accordance with our Return & Exchange Policy.

17. Customer Acknowledgement & Acceptance

a) You have read, understood, and accept the authenticity, handmade nature, cultural heritage disclosures, and all terms stated in our Disclaimer.

b) You agree to the Privacy & Data Protection Policy outlined in our Privacy Policy.

c) You consent to the Cookies Usage & Management Policy set out in our Cookie Policy.

d) You accept the Return, Exchange & Refund Policy described in our Refund Policy.

e) You agree to the Shipping & Delivery Policy contained in our Shipping Policy.

In addition, by continuing to use the Site, you further:

a) Confirm you are legally competent to contract (i.e., at least 18 years old or the age of majority in your jurisdiction) and are authorised to bind yourself (or the entity you represent).

e) Understand that handcrafted products naturally exhibit variations (in weave, print, colour, finish, etc.); such characteristics alone do not constitute defects beyond what is covered in our policies.

f) Accept that failing to follow required procedures (for example, reporting windows or mandatory unpacking videos) may limit or extinguish available remedies.

g) Agree that any dispute will be handled in accordance with the Dispute‑Resolution Framework set out in these Terms of Use.

If you do not agree with any part of these Terms or the incorporated policies, we respectfully request that you discontinue use of the Site and refrain from placing orders.

18. Dispute‑Resolution Framework

Friendly first. If something goes wrong with an order, please email/call us and we shall call you back at the earliest. Most issues disappear once we talk.

a) Direct Dialogue

We’ll aim to settle the matter by email, WhatsApp or voice within five (5) business days. Direct negotiation is the quickest, least‑cost path for everyone.

b)  Voluntary Mediation

If a solution proves elusive, either party may invite a neutral mediator accredited by the Odisha State Legal Services Authority. Mediation is voluntary, confidential and typically faster than court.

c)  Binding Arbitration

Should mediation stall, the dispute may be referred to sole arbitration seated in Bhubaneswar, Odisha under the Indian Arbitration & Conciliation Act, 1996.

  1. Rules & Language: Proceedings will follow the Act’s Part I defaults; hearings and filings shall be in English.
  2. Award: The arbitrator’s decision is final and enforceable in any competent court.

3. Costs: The arbitrator may apportion fees and expenses as deemed fair.

d)  Small‑Claims Carve‑Out

Either party may opt for the civil judge (small‑cause court) if the amount in dispute falls below the monetary ceiling fixed for such courts in Odisha. This route does not require prior mediation or arbitration.

e)  Collective Actions

All proceedings must be brought on an individual basis. Class, collective, or representative actions are waived to the extent permitted by Indian law.

f)  Governing Law & Jurisdiction

This policy—and any dispute not resolved by the steps above—shall be governed by the laws of India. Subject to the arbitration clause, the courts at Bhubaneswar, Odisha (INDIA) hold exclusive jurisdiction.
